Last updated: January 2026
This Privacy Policy explains how Jardin Omaëlle SARL, the company operating the website jardinomanaelle.site, collects, uses, stores and protects personal data when you visit the website or send us a request through the contact form. We are an independent information and guiding service based in Marrakech. We are not affiliated with the Fondation Jardin Majorelle, the Musée Yves Saint Laurent Marrakech or any official ticketing office, and we do not sell entrance tickets to the garden. We respect your privacy and process personal data in accordance with Moroccan Law No. 09-08 of 18 February 2009 relating to the protection of individuals with regard to the processing of personal data, and with the guidance of the Commission Nationale de contrôle de la protection des Données à caractère Personnel (CNDP).
1. Data Controller
The data controller responsible for your personal data is Jardin Omaëlle SARL, 12, Rue de la Palmeraie, Guéliz, 40000 Marrakech, Morocco. Patente: 47281965. Identifiant Fiscal: 39284710. You can reach us by email at [email protected] or by telephone at +212 524 38 47 29 on working days between 9:00 and 18:00 Moroccan time.
2. Personal Data We Collect
We only collect data that you choose to give us. When you complete the request form on our contact page, we receive the following information:
- Your first name and last name
- Your telephone number
- Your email address
- The type of service you are interested in, such as a guided walk or a workshop
- Any message you write, for example your preferred travel dates or group size
We do not ask for passport numbers, payment card details, health information or any other sensitive data through this website. Please do not include such information in the free text message field. Our web hosting provider may automatically record basic technical information, such as IP address, browser type and the time of a request, in server logs used for security and stability purposes.
3. Purposes and Legal Basis
We use your personal data only for clearly defined purposes:
- To answer your questions about visiting the Jardin Majorelle area and Marrakech gardens
- To prepare a quote or proposal for a guided walk, a botanical workshop or a city itinerary
- To organise a service you have requested and to contact you about practical details
- To keep basic records required by Moroccan accounting and tax law when a service is provided
- To protect the security of our website and prevent misuse
We process your data on the basis of your consent, given when you submit the form, and where necessary to take steps at your request before entering into an agreement. You may withdraw your consent at any time by writing to us. Withdrawal does not affect processing carried out before it.
4. No Marketing and No Sale of Data
We do not send newsletters or advertising emails unless you have explicitly asked for them. We never sell, rent or trade your personal data to third parties. We do not use your data for automated decision making or profiling.
5. Sharing of Data
Your data is accessed only by the small team of Jardin Omaëlle SARL who handle requests. We may share limited details with a licensed partner guide or workshop host only when this is necessary to deliver a service you have booked with us, and only after informing you. Our hosting provider stores website files and logs on our behalf under a confidentiality agreement. We may disclose data if required by Moroccan law, a court order or a competent public authority.
6. International Transfers
We aim to keep your data within Morocco. If a technical provider stores data outside Morocco, we only use providers that offer an adequate level of protection, in line with the requirements of Law 09-08 and the authorisations of the CNDP.
7. Retention Period
Requests that do not lead to a service are deleted within twelve months of our last contact with you. Where a service is provided, the minimum information needed for invoices and accounting is kept for the period required by Moroccan commercial and tax law, normally ten years. Server logs are usually kept for no longer than ninety days.
8. Your Rights
Under Law 09-08 you have the following rights regarding your personal data:
- The right to be informed about how your data is processed
- The right of access to the data we hold about you
- The right to rectification of inaccurate or incomplete data
- The right to object, on legitimate grounds, to the processing of your data
- The right to request deletion of data that is no longer needed
To use any of these rights, send an email to [email protected] with the subject line "Data request". We will answer within thirty days. If you believe your rights have not been respected, you may file a complaint with the CNDP, the Moroccan data protection authority, in Rabat.
9. Security
We use reasonable technical and organisational measures to protect personal data against loss, misuse and unauthorised access. These include a secure HTTPS connection, restricted access to our mailbox and regular deletion of old requests. No method of transmission over the internet is completely secure, but we work to keep risks as low as possible.
10. Cookies
This website does not use advertising or analytics cookies. More information is available in our Cookie Policy.
11. Children
Our services are intended for adults planning trips. We do not knowingly collect data from children under sixteen. If you think a child has sent us personal data, please contact us and we will delete it.
